By registering for a class with Performance on Demand Shooting, LLC – you agree to the following terms and conditions:

PAYMENTS AND REFUNDS
Full payment is due prior to class unless prior arrangements are made. Student cancellations made up to 30 days prior to a class will be issued a full refund, or student may elect to have tuition applied to another class. Student cancellations made within 30 days of the scheduled class will not be issued a refund or transfer to another class unless the class is at capacity and another student can be found to replace the student who cancelled. Please understand that there are range fees and other costs associated with running a training company. None of our instructors work full-time for Performance on Demand Shooting. At times, we have to take days away from our primary jobs to run training classes. As such, short-notice cancellations cannot be issued refunds unless the above criteria are met.

That said, we understand emergencies and schedule changes come up. We will do our best to find another student to take your spot and often times we have a lengthy waiting list for our classes.  If a course is cancelled by us, you will receive a full refund. We require payment in advance of class for all government agency students and training as well.

Students removed from class for safety violations will not be issued a refund.

AFFIRMATION OF REGISTRANT THAT STUDENT IS NOT LEGALLY PROHIBITED FROM POSSESSING A FIREARM
By registering for a class with Performance on Demand Shooting LLC, you affirm, that you are of sound mind, and not prohibited for any reason, from possessing a firearm or ammunition. You also affirm that you are not seeking firearms training in pursuit of any unlawful or criminal activity. We reserve the right to deny a training application for any reason. We will fully cooperate with law enforcement if it is discovered a student is prohibited from possessing firearms, or engaged in unlawful activity.

AFFIRMATION THAT STUDENT IS A U.S. CITIZEN OR LEGAL PERMANENT RESIDENT
Due to DoS ITAR regulations, firearms/tactical training is only available to US Citizens and persons with legal, permanent resident alien status. By registering for this class, you affirm that you are a US citizen or legal, permanent resident alien.

LIABILITY WAIVER
All students will be required to sign a standard liability waiver prior to participating in any training conducted by Performance on Demand Shooting, LLC.

MEDIA RELEASE
On occasion, Performance on Demand Shooting, LLC will record sections of its classes and students. This may include, but is not limited to still photography, video and audio. This media may be used for promotional, training or other lawful purposes by Performance on Demand Shooting, LLC. By registering for a Performance on Demand Shooting LLC course, you agree to allow Performance on Demand Shooting, LLC to use any media recorded of you in class in the above mentioned instances, and waive any rights or royalties in regards to that media.

MEDIA RELEASE OPT-OUT

We respect the privacy of our students. We realize some of our students may be in sensitive military or police units where their faces or images cannot be associated with law enforcement / government training (for example, and undercover narcotics officer). Some students simply may not want their image used for any reason. If you would not like any media captured of you during a class used by Performance on Demand Shooting LLC, you must make such a request known in writing (or email) prior to the start of the class.

SAFETY AND CONDUCT
By registering for a Performance on Demand Shooting LLC course, you take full responsibility for your actions on and off the range. You recognize firearms training is an inherently dangerous activity, which may result in yourself or others being seriously injured or killed. You understand that if you shoot yourself or another person, it is your fault. You are responsible for any damage to property you cause due to negligence or intentionally unsafe acts. You agree to follow instructor’s directions at all times and to obey the following cardinal rules of firearms safety at all times:

1. Treat all firearms as if they were loaded
2. Never let your muzzle cover anything you are not willing to destroy, including yourself, instructors, observers and other students.
3. Keep your finger off the trigger and outside the trigger guard until your sights are on target and you are ready to shoot.
4. Be aware of your target, what is beyond it, what is around it and what is infront of it.

Students must be aware of the pre-requisite requirements to attend certain courses. It is our mission to provide the absolute best possible firearms training to our all of our students, however, if you cannot perform a certain task proficiently enough to the extent where it compromises safety or severely holds up the progress or speed of the course, you may be asked to refrain from participating in a specific drill or segment of the course.

We are guests at many of the ranges we use. Violating local range rules, acting in a violent, threatening, lewd or disorderly manner will not be tolerated. Use of alcohol before or during any gun-handling activities is not permitted. The use of illegal drugs, including the use of medical marijuana is not permitted. Federal law prohibits anyone using, or addicted to illegal drugs from possessing firearms or ammunition. If it is discovered any student is under the influence of illegal drugs, impaired by alcohol consumption, or is legally prohibited from possessing firearms, that student will be removed from the class and the alleged violation will be reported to the appropriate law enforcement agency if warranted. The tolerance for blood alcohol concentrations while shooting is 0.0 g/210L. Additionally, students affirm they will not be under the influence of legal, prescription or OTC drugs which impair their judgement or ability to handle a firearms.

If an instructor believes a student is unable to perform a portion of the class safely, the instructor may elect of have the student sit out for that portion of the class. Students who demonstrate a minor safety infraction may be warned once. Repeated unsafe weapon handling, unsafe or reckless conduct, or failure to follow instructor’s directions may result in the student being removed from the class and range. A serious safety or conduct violation may result in the student being removed from the class without prior warning. Anyone removed from a class due to safety or conduct will not be issued a refund.
